PARTICIPANT END USER THROUGH THE UHC STORE TERMS OF USE

1. Introduction

Welcome to Mune Health. These Participant End User Terms of Use (“Terms”) govern your access to and use of the Mune Health program, digital application, and related services (collectively, the “Services”) provided by Mune Health Inc. (“we,” “our,” or “us”). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms constitute a legally binding agreement between you, as the user of our Services (“you” or “User”), and Mune Health Inc. If you do not agree to these Terms, please do not access or use our Services.

2. Relationship with UHC Store

You acknowledge that you have purchased access to our Services through the UHC Store. Your payment terms, subscription renewal, and related purchase matters are governed by the separate UHC Store Terms and Conditions (“Store T&Cs”) to which you agreed when making your purchase. These Terms do not modify, replace, or supersede the Store T&Cs with respect to payment matters.

As a Purchasing Member (as defined in the Store T&Cs), your relationship with Mune Health Inc. is governed by these Terms, while your purchase, payment, and subscription renewal terms are governed by the Store T&Cs.

3. Services Description

Mune Health Inc. provides a personalized program focused on supporting individuals with autoimmune conditions. Our Services include:


a) Access to an individual coach who helps identify potential root causes of autoimmune symptoms such as flare-ups, pain, and brain fog;


b) A tailored support program designed to help manage symptoms, ease lifestyle changes, and help you stay on track;


c) Guidance for navigating daily life with a focus on self-management skills, coping strategies, and practical resources; and


d) A digital health application that helps with tracking food and symptoms, and provides access to a restaurant guide and other educational resources.

The program includes virtual sessions with a health coach.

IMPORTANT: THIS PROGRAM DOES NOT PROVIDE MEDICAL ADVICE OR TREATMENT SERVICES.

  • All information, educational content, materials, strategies, and techniques contained in the program are for wellness and educational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Any information or techniques gained from the use of this program should be shared and discussed with your treating provider before any consideration is made to use it for any health condition or care.
  • Always seek the advice of your physician or other qualified/licensed healthcare provider for any questions you may have regarding a medical condition or treatment, taking or changing medications, and before undertaking any new health care program.

5. User Accounts

5.1 Account Creation

To access certain features of our Services, you may be required to create an account and provide certain personal information. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.


5.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions taken under your account. You agree to notify Mune Health Inc. immediately of any unauthorized use of your account or any other breach of security.


5.3 Account Termination

We reserve the right to disable or terminate your account at any time if, in our sole discretion, you have violated these Terms or if your continued use of the Services would cause us legal liability.

6. User Responsibilities

6.1 Compliance with Terms

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

6.2 Prohibited Activities

You agree not to:

  • Use the Services in any manner that could damage, disable, overburden, or impair the Services
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services
  • Use any automated means to access the Services or collect any information from the Services
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

7. Intellectual Property

7.1 Ownership

The Services, including all content, features, and functionality, are owned by Mune Health Inc. and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 License

Subject to your compliance with these Terms, Mune Health Inc. grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use.

7.3 Restrictions

You may not:

  • Copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Services without our prior written consent
  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services
  • Use the Services for any commercial purpose or for the benefit of any third party

8. User Content

8.1 User Content Definition

“User Content” means any information, data, text, or other materials that you submit, upload, or otherwise provide to the Services, including information provided during coaching sessions, health tracking data, and feedback.


8.2 License to User Content

By submitting User Content to the Services, you grant Mune Health Inc. a worldwide, non-exclusive, royalty-free license to use, copy, process, and store such User Content to provide and improve the Services.


8.3 Responsibility for User Content

You are solely responsible for your User Content and the consequences of submitting it. You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate the rights of any third party.

9. Limitation of Liability

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy explains how we collect, use, and protect your personal information when you use our Services.

10. Disclaimers

10.1 Service Availability

The Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.


10.2 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, Mune Health Inc. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


10.3 Health-Related Information

Any health-related information provided through the Services is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Mune Health Inc. does not provide medical advice or treatment services.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Mune Health Inc. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Mune Health Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

13. Modifications to the terms


We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you through the Services or by other means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

16. Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Delaware.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

18. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mune Health Inc. regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Mune Health Inc..
